Many individuals ask whether 50/50 custody or 50% time with the children for each parent is a likely outcome in their case and the reality is under the current construct of Texas Law, 50/50 custody is not preferred and it’s not generally what courts will do. Now if two consenting adults and parents agree that a 50/50 schedule is best for them and more importantly for their children, that can be done. Further, 50/50 possession schedules do happen in courtrooms. They might be rarer than the traditional expanded standard possession schedule, but 50/50 custody arrangements actually do occur after contentious hearings resulting in a judge making a decision of 50/50 possession.
