Trial happens only if you and your spouse cannot reach agreements. And if there’s any particular topic that you can’t reach an agreement about, the individual that will ultimately decide is the judge. There are some rare cases that are appropriate in Texas for a jury to decide. But most cases go to what’s called a bench trial or have a judge decide.
